The historical shows that there were some offenders of international crimes who have not been tried because of immunity. The expansion of outcomes of international crimes, especially in the two recent centuries, enforced international community to react. Accordingly, the states during the second half of the 20th century decided to create mechanisms for combating impunity of the accused of international crimes. The offenders need to be tried and punished. This has been recognized as the ideal of international community. To achieve its purpose, the community tried to use different mechanisms. All trials done during the history, from Breisach to Rome, in particular trials by Nuremburg Tribunal, International Criminal Tribunal for Yugoslavia and Rwanda, indicate the seriousness of the community in combating the impunity of the offenders of international crimes. By participating in diplomatic conference in Rome (1998), the states reemphasized that they are faithful to combat impunity. The outcome of the conference was adoption of Rome Statute. It has entered into force in 2002 and resulted in creation of the International Criminal Court (ICC). One of the main purposes of the Court is to fight against impunity. By this way, it has helped to realization of one of the ideals of the international community. To realization of its purposes, especially for trial and punishment of the offenders of international crimes, the court needs special mechanisms. They have been provided for by the Rome Statute. By applying these mechanisms, the court tries to fight against impunity.  }, keywords = {Rome Statute,International Criminal Court,Impunity,jurisdictions of the Court,International Crimes}, title_fa = {سازوکارهای دیوان بین المللی کیفری برای مبارزه با بی کیفری}, abstract_fa = {پدیده بی ­کیفر ماندن آن دسته از افرادی که مرتکب اعمالی تحت عنوان جنایات بین­ المللی می ­شوند مشکلاتی را در روابط میان دولت­ها و جامعه جهانی ایجاد نموده است. در بررسی های تاریخی می­ توان شاهد این امر بود که در میان متهمان به ارتکاب جنایات بین ­المللی همواره کسانی که از مصونیت یا اقتدار کافی برخوردار بوده ­اند هیچ­گاه به میل خود تسلیم عدالت نشده اند. گستردگی اثرات زیان­باری که جنایات بین ­المللی به ­ویژه در دو قرن حاضر بر جای گذاشته، جامعه بین­ المللی را به واکنش واداشته است. با توجه به این امر، دولت­ها در نیمه دوّم قرن بیستم بر آن شدند که سازوکارهایی برای مبارزه با بی­ کیفری این متهمان بیاندیشند. مرتکبان جنایات بایستی محاکمه و مجازات می­ شدند. این امر به عنوان آرمان اجتماع بین ­المللی شناخته شده است. این اجتماع برای رسیدن به این هدف خود سعی در بکارگیری سازوکارهای متفاوتی داشته است. محاکمات صورت ­گرفته از بریساخ تا رم به ­ویژه محاکمات صورت­ گرفته در دادگاه­های نورنبرگ و توکیو، یوگسلاوی سابق و روآندا، نشان­ دهنده جدیت جامعه بین ­المللی در مبارزه با بی ­کیفری مرتکبان جنایات بین ­المللی است. کشورها با شرکت در کنفرانس دیپلماتیک رم در سال 1998 بار دیگر تأکید نمودند که بر عهد خود در مبارزه با بی ­کیفری پایبندند. نتیجه این کنفرانس دیپلماتیک تصویب اساسنامه رم بود که با لازم ­الاجرا شدن آن در سال 2002 دیوان بین ­المللی کیفری تشکیل شد که یکی از اهداف اصلی آن مبارزه با بی ­کیفری جنایات است. دیوان با تعریف این هدف برای خود سعی در برآوردن یکی از آرمان­های دیرینه جامعه بین ­المللی دارد. دیوان برای جامه عمل پوشانیدن به اهداف خود به­ ویژه در محاکمه و مجازات مرتکبان جنایات بین ­المللی، نیازمند دارا بودن سازوکارهای خاصی است. این سازوکارها در اساسنامه رم به دیوان اعطا شده است و دیوان با بهره ­گیری از این سازوکارها سعی در مبارزه با بی ­کیفری دارد.}, keywords_fa = {اساسنامه رم,دیوان بین المللی کیفری,بی کیفری,صلاحیت موضوعی}, url = {https://www.ghazavat.org/article_165936.html}, eprint = {https://www.ghazavat.org/article_165936_34af0326495e513843cd548f2d9cf128.pdf} }
