Although investigator is no more than one title but it includes two sets of different judicial and investigative status. The criminal procedure begins with the discovery of the offence and then, the prosecutor as the representative of the society prosecutes such offence. Investigation or collection of evidence after such prosecution is conducted by investigator. Afterward, the case enters into court proceedings. Iran Code of Criminal Procedure, following the French model, has been designed on the basis of existence of investigator, while global tendency is to remove this institution from the criminal proceedings. According to Code of Criminal Procedure, on the one hand, the investigator attempts to collect evidence based on his investigative status and on the other hand, decides about arresting or releasing of individuals based on his judicial status. According to Code of Criminal Procedure enacted on 2014, the investigator is subordinate to prosecutor. Substantial part of orders issued by investigator needed to be confirmed by prosecutor and without confirmation of prosecutor, orders of investigator has no legal effect. Even, the injunction order has no effect until approved by prosecutor. In fact, investigator is a neutral judge who must respect neutrality in collecting the evidence in accordance with law and follow the prosecutor. Such judge is required to prosecute all offences without exercising his discretion.}, keywords = {Preliminary Investigation,Criminal Procedure,Investigator,Investigative Tasks,Judicial Functions}, title_fa = {مطالعه جایگاه «بازپرس» در قانون قدیم و جدید آیین دادرسی کیفری}, abstract_fa = {بازپرس، یک عنوان برای دو مقام محسوب می‌شود؛ بدین معنا که دو شأن کاملاً متفاوت تحقیقاتی و قضایی را در خود جمع کرده است. همچنین، بازپرس مقامی است که ویژگی‌های بی‌­طرفی قوه قضائیه، مهارت‌­های تحقیقی و تخصصی پلیس و نیز ویژگی­‌های قضات هیأت منصفه عالی را در خود جای داده است. فرآیند دادرسی کیفری با کشف جرم آغاز شده و سپس تعقیب جرم از سوی دادستان به عنوان نماینده جامعه صورت می‌­گیرد. تحقیق یا جمع‌­آوری دلایل مربوط به جرم نیز پس از تعقیب، از سوی بازپرس انجام شده و بعد از آن پرونده برای رسیدگی به دادگاه می‌­رود. دادرسی کیفری ایران به تبعیت از دادرسی کیفری فرانسه، بر مبنای وجود بازپرس طراحی شده و این در حالی است که جامعه جهانی به حذف این نهاد در دادرسی کیفری تمایل دارد. در ایران، بازپرس بر اساس شأن تحقیقی خود اقدام به جمع‌­آوری دلایل کرده و از سوی دیگر بر اساس شأن قضایی خود راجع به آزاد یا بازداشت بودن افراد تصمیم­‌گیری می‌­نماید. بازپرس در قانون آیین دادرسی کیفری مصوب 1392 زیردست دادستان قرار داده شده و سایه دادستان بر سر او مستدام است. عمده قرارهای بازپرس باید به تأیید دادستان برسد و محقق شدن آثار قرارها ممکن نیست مگر آن که تصمیمات بازپرس به تأیید دادستان رسیده باشد. حتی قرار منع تعقیب بازپرس بدون تأیید دادستان منشأ هیچ اثری نمی‌­باشد. در واقع، بازپرس یک قاضی بی‌­طرف است و بر اساس قانون باید بی‌­طرفی را در جمع‌­آوری دلایل رعایت کند و بایستی زیر چتر قاضی تعقیب (دادستان)، تمام جرایم را تعقیب کند بدون آن که حق اعمال صلاحدید داشته باشد.}, keywords_fa = {تحقیقات مقدماتی,دادرسی کیفری,بازپرس,وظایف تحقیقی,وظایف قضایی}, url = {https://www.ghazavat.org/article_177655.html}, eprint = {https://www.ghazavat.org/article_177655_c5e5aff40a585662f2c7b474ac5622e0.pdf} }
