This principle is also stipulated in article 173 of the Islamic penal code of 1392, but in two instances, the confession may be denied or revoked, and there are where a person admits the commitment of a crime that its punishment is stoning to death and blood vengeance by talion. There is also a third exception that the law is silent about, that is, the mutual confession to the murder. However, there is no consensus among the jurisprudents in this regard. A group believe in the falling of blood vengeance by talion and blood money and the payment of blood money from the treasury, and another group believe that blood vengeance by talion and blood money must be honoured.}, keywords = {confession,Revocation of Confession in Murder,Revocation of Confession in Fixed Punishment (Hadd)}, title_fa = {بررسی فقهی حقوقی مصادیق رجوع از اقرار در امور کیفری}, abstract_fa = {طبق قاعده فقهی «اقرار العقلا علی انفسهم جایز»، هرکس اقرار به حقی برای غیر کند ملزم به اقرار خود خواهد بود و درصورتی‌که اقرار واجد جمیع شرایط صحت باشد، با توجه به قاعده «منع انکار بعد از اقرار» که مورد اتفاق فقها و حقوقدانان است، رجوع از آن مگر در صورت وجود شرایطی، ممکن نخواهد بود، از قبیل اثبات ادعای فاسد، اشتباه و غلط بودن و ... که در این حالت بنابه تجویز ماده 1277 قانون مدنی، اقرار قابل انکار یا رجوع خواهد بود. در امور کیفری نیز به این اصل کلی در ماده 173 قانون مجازات اسلامی مصوب 1392 اشاره گردیده لکن در دو مورد اقرار را قابل انکار یا رجوع دانسته است و آن جایی است که شخص به جرمی اقرار می‌نماید که مجازات آن رجم یا حد قتل می‌باشد. البته مورد سومی نیز وجود دارد که قانون نسبت به آن ساکت است و آن جایی است که اقرار متقابلی نسبت به قتل صورت می‌گیرد که در این خصوص بین فقها اختلاف وجود دارد. دسته نخست معتقد به سقوط قصاص و دیه و پرداخت دیه از بیت‌المال هستند و دسته‌ای دیگر قائل به عدم سقوط قصاص و دیه می‌باشند.}, keywords_fa = {اقرار,رجوع از اقرار در حدود,رجوع از اقرار در قتل}, url = {https://www.ghazavat.org/article_210547.html}, eprint = {https://www.ghazavat.org/article_210547_d2b6838e620b361cf0b78c6ea8a429bd.pdf} }
