Germany contended that the United States violated the right to consular which provided in Article 36 of Convention on Consular Relations and provisional measures of The Court which was issued to suspend the execution of the second brother until the final judgment of The Court. The Court declares that provisional measures is binding and creates an international legal obligation for the concerned state. The Court adds that the rights contained in the Convention on Consular Relations (Article 36), in addition to the creation of international obligations to the United States vis-à-vis other states parties, entail individual rights for LaGrand brothers. This interpretation of article 36, as well as the Court's approach to the binding nature of provisional measures and the responsibility for the violation, in particular the method of reparation of this violation, namely, continuous performance for non-repetition of internationally wrongful act, is an indication of the importance of this judicial mechanism in terms of guaranteeing the enforcement of international law.}, keywords = {International Court of Justice,LaGrand,Provisional Measures,Interim Order,Consular Access}, title_fa = {اقدامات تأمینی (دستور موقت) دیوان بین‌المللی دادگستری: الزام یا توصیه؟ نگاهی دوباره به رأی دیوان بین‌المللی دادگستری در قضیه برادران لاگراند}, abstract_fa = {در پی محکومیت برادران لاگراند به اعدام و اجرای حکم یکی از آنها در ایالات متحده آمریکا، دولت متبوعشان (آلمان) با استناد به نقض کنوانسیون روابط کنسولی (1963) و با توسل به پروتکل نخست منضم به این کنوانسیون، به دیوان بین‌المللی دادگستری مراجعه نمود. خواهان مدعی بود که آمریکا حق اطلاع و دسترسی کنسولی مندرج در ماده 36 کنوانسیون روابط کنسولی و نیز دستور موقت دیوان را که به‌منظور تعلیق اجرای حکم اعدام برادر دوم تا زمان تصمیم‌گیری نهایی دیوان صادر شده بود، نقض کرده است. دیوان در بررسی خواسته‌های خواهان به دستاوردهای مهمی دست پیدا می‌کند. دیوان اعلام می‌کند که دستور موقت صادره از دیوان الزام‌آور است و برای دولت مخاطب تعهدات حقوقی بین‌المللی ایجاد می‌کند. به‌علاوه، دیوان اعلام می‌دارد که حقوق مندرج در کنوانسیون روابط کنسولی (ماده 36) علاوه‌بر ایجاد تعهدات بین‌المللی برای آمریکا، در قبال سایر دولت‌های عضو متضمن حقوق فردی برای برادران لاگراند است. این تفسیر از ماده 36 و نیز رویکرد دیوان در مورد الزام‌آور بودن دستور موقت و مسئولیت ناشی از تخلف از آن بویژه روش جبران این تخلف، یعنی اجرای مستمر به عدم تکرار عمل متخلفانه، نشانه‌ای از اهمیت این سازوکار قضایی از حیث تضمین اجرای حقوق بین‌الملل است.}, keywords_fa = {دیوان بین‌المللی دادگستری,لاگراند,اقدامات تأمینی,دستور موقت,دسترسی کنسولی}, url = {https://www.ghazavat.org/article_216274.html}, eprint = {https://www.ghazavat.org/article_216274_459ae8409a7e9a00f5988f819b9c4cd8.pdf} }
