On the other hand, however, if financial institutions are not supervised by sovereign institutions, in some cases, due to a conflict of their own financial interests with said policies, they may refuse to abide by these legal requirements, including interest rates paid to depositors, type of contracts for awarding facilities to applicants and the interest rates thereof, and may, on occasion, drive most of their resources to nonproductive, or even disruptive, economic sectors in pursuit of greater interests. Furthermore, poor management makes said institutions incapable of even reimbursing depositors, bringing about disasters in the financial system, the likes of which can be observed in today’s Iran. Bank contracts, first and foremost, follow general rules of contract law and have further legal conditions and principles of their own, and even legislators have allowed them certain privileges. Considering the lack of a legal authorization due to nonobservance of genuine transaction conditions, one can safely assume that these institutions lack the required qualification and competence for entering into bank contracts, however, as viewed by economic law, the need for creating a competitive market, and the detrimental impacts of nullifying such contracts, facility contracts must be judged as genuine, nonetheless.}, keywords = {Financial A\and Credit Institutions,capital,Allocation of Resources,Economic Analysis,Monetary Policy}, title_fa = {تحلیل اقتصادی معاملات مؤسسات مالی غیرمجاز}, abstract_fa = {یکی از مهمترین عوامل رسیدن به این اهداف در تمامی کشورها، عملکرد صحیح و منطبق با مقررات و سیاست‌های تعیینی نهادهای حاکمیتی و مالی ازجمله تخصیص اعتبارهای خود به نهادهای تولیدی توسط مؤسسات مالی و بانک‌ها می‌باشد تا فعالان اقتصادی در بخش تولیدی نیاز خود به منابع مالی را از طریق دسترسی سریع و مکفی به تسهیلات اعطایی برطرف نمایند که یکی از اثرات مهم آن در اقتصاد، رشد اقتصادی و به‌تبع آن افزایش اشتغال است. لکن از طرف دیگر چنانچه مؤسسات مالی، تحت نظارت نهادهای حاکمیتی نباشند در برخی موارد به‌جهت تعارض این سیاست‌ها با منافع مالی خود، از رعایت این الزامات قانونی ازجمله میزان سود پرداختی به سپرده‌گذاران، نوع قراردادهای تسهیلات اعطایی به متقاضیان و میزان سود متعلق به آنها، استنکاف می‌ورزند و حتی در برخی از موارد به‌جهت کسب سود بیشتر، منابع خود را به‌سمت بخش‌های غیرمولّد و حتی مضر اقتصادی هدایت می‌کنند. همچنین به‌سبب عدم مدیریت صحیح، حتی توانایی استرداد پول‌های سپرده‌گذاران خود را نداشته و امروزه شاهد چنین حوادثی نیز هستیم که منجر به ایجاد بحران در نظام مالی می‌شود. قراردادهای بانکی در وهله اول به‌عنوان یک قرارداد، تابع قواعد عمومی قراردادها بوده و دارای شرایط قانونی و اصول حاکم مختص به خود هستند که حتی قانونگذار در مواردی امتیازات خاصی برای آنها قائل شده است. با توجه به فقدان مجوز قانونی به‌لحاظ عدم رعایت شرایط صحت معاملات می‌توان قائل به این نظر بود که چنین مؤسساتی صلاحیت و اهلیت لازم برای انعقاد قراردادهای بانکی را ندارند، لکن از منظر حقوق اقتصادی و نیاز به ایجاد بازار رقابتی و آثار زیان‌بار ابطال چنین معاملاتی، حکم قراردادهای تسهیلاتی، صحت می‌باشد.}, keywords_fa = {مؤسسات مالی و اعتباری,سرمایه,تخصیص منابع,تحلیل اقتصادی,سیاست پولی}, url = {https://www.ghazavat.org/article_222470.html}, eprint = {https://www.ghazavat.org/article_222470_a9f918a10efdcc79bb6d63c1c170cb0b.pdf} }
