چکیده
از اواخر سده بیستم میلادی، حمایت از بزهدیدگان در نظام بینالملل در قالب جنبشهای حمایت از بزهدیدگان، کنوانسیونها و دیگر اسناد بینالمللی مورد توجه جدی جامعه جهانی قرار گرفته است. اساسنامه دیوان کیفری بینالمللی مقررات قابل توجهی در خصوص حمایت از بزهدیدگان و بازماندگان جنایتهای بینالمللی را دربر دارد و در مواردی اقدام به نوآوری نموده و جایگاه رفیعی را برای بزهدیده در فرآیند عدالت کیفری بینالمللی به ارمغان آورده است. حفاظت و حمایت از بزهدیدگان و شهود، امکان مشارکت بزهدیده در فرآیند دادرسی، اعطای نمایندگی خاص به بزهدیدگان و جبران خسارات قربانیان جرایم بینالمللی تحت صلاحیت دیوان، از جمله مواردی است که در دادگاههای کیفری بینالمللی پیشین مورد غفلت قرار گرفته بود. مفهوم «بزهدیده» در اسناد دیوان کیفری بینالمللی نیز در مقایسه با تعاریف ارائه شده در گذشته، گستردهتر میباشد و علاوه بر شناسایی ضمنی بزهدیدگان غیر مستقیم، با پذیرش اشخاص حقوقی به عنوان بزهدیده، دامنه شمول آن در جهت منافع قربانیان گسترش یافته است. مقررات دیوان کیفری بینالمللی در ارتباط با حقوق حفاظتی، مشارکتی و جبران خسارت بزهدیدگان، تحول چشمگیری در حقوق بینالملل کیفری به شمار میآید.
