Duties, assignments and powers of bailiff as a civil servant in charge of enforcement of provisions and stipulations of judgment and writ of execution have been studied specifically in the Civil Judgments Enforcement Act. Since implementation of justice is of sovereignty affairs, enforcement of justice which is the result of fulfillment of justice and its concrete manifestation demonstrated in the judgment, will be referred to the bailiff through writ of execution for enforcement or in accordance with the written laws will be put into force (like enforcement of an injunction). The results of the research show that if the bailiff intentionally causes damage to other person he will be held responsible. Sovereignty acts of the judiciary will not negate his responsibility in causing losses as a result of negligence. In view of duties of bailiffs, he will be personally held accountable for losses caused by him. In distribution of responsibility, except for cases explicitly stated in the law, one cannot accept that responsibility is to be held jointly and severally.In combination of means, where the court is involved this way or that, the bailiff will not have any responsibility. Should all factors play an equal role, they will be responsible on equal basis. With faults in means of enforcement, the bailiff will not be responsible. Where damage is caused as a result of fault in means of government and the negligence of the bailiff, they will be both responsible. If means vary in causing of damage, administration of justice requires that the responsibility be distributed proportionate with the extent of involvement.}, keywords = {Civil Liability,Bailiff,enforcement of judgments}, title_fa = {مسئولیت مدنی دادورز}, abstract_fa = {روش تحقیق در این مقاله، کتابخانه ای و اسنادی است. دادورز، از جمله کارمندان دولت است که عهده دار عملی کردن مفاد و مندرجات رأی و اجرائیه می باشد. وظایف وی به عنوان یک مستخدم و تکالیف و اختیارات او در قانون اجرای احکام مدنی به طور خاص مورد بررسی قرار گرفته است. از آنجایی که اجرای عدالت از امور حاکمیتی می باشد، اجرای احکام، ثمره ی تحقّق عدالت وآیینه تمام نمای آن است که در قالب رأی ارائه شده است که رأسا مانند اجرای دستور موقت یا به وسیله ی اجرائیه برای اجرا به دادورز ارجاع می گردد یا حسب قوانین موضوعه مکلّف به اجرای رای می شود. از نتایج این تحقیق این است که دادورز چنانچه عمدا به دیگری خسارت وارد نماید مسئول است و اعمال حاکمیتی قوه ی قضائیه، نافی مسئولیت او در ایراد زیان در اثر تقصیر نیست. اختیارات دادورز، در قانون اجرای احکام اقتضای پاسخگویی شخصی ومسئولیت در برابر ایراد خسارت است. در توزیع مسئولیت، به غیر از موارد مصرّحه ی قانونی، نمی توان پذیرفت مسئولیت به نحو تضامن باشد. در اجتماع اسباب در صورت دخالت دادگاه به هر طریقی ، دادورز مسئولیت نخواهد داشت. در صورتی که همه ی عوامل نقش برابر داشته باشند مسئولیت برابر دارند. با نقص وسایل، به موجب ماده ی 11 قانون مسئولیت مدنی ، دولت و در صورت توجه زیان به نقص وسایل و تقصیر دادورز، هر دو مسئول اند. چنانچه برخی از اسباب، نقش بیشتری در ایراد زیان داشتند اقتضای عدالت و انصاف است که مسئولیت به میزان دخالت باشد.}, keywords_fa = {مسئولیت مدنی,دادورز,اجرای احکام}, url = {https://www.ghazavat.org/article_153424.html}, eprint = {https://www.ghazavat.org/article_153424_01ab76da28b1462147f09050356a7139.pdf} }
