This includes proving criminal behavior such as its act or omission nature, attribution of the criminal act to the perpetrator, general and specific ill-will and knowledge and intention in deliberate crimes and criminal culpability in unintentional crimes, which actus reus can be substantiated by referring the matter to the expert. Although the Islamic Penal Code and the Code of Criminal Procedure do not order the judge's adherence to expert opinion and such opinion is recognized only as one of the scientific evidences for the judge, the judicial procedure approach to referring the case to experts to investigate the effects and consequences of the crime, whether electronic or medical, such as texting, fingerprints, semen, blood stains, saliva, etc., as well as examining the statements of witnesses, informants, plaintiffs and defendants, indicate the courts' attention and perhaps de facto adherence to scientific evidence (expert opinion) to substantiate the material element (actus reus) of the crime.}, keywords = {Burden of Proof,crime,Actus Reus,Expert,judicial procedure}, title_fa = {اثبات عنصر مادی جرم با استناد به نظریه کارشناسی}, abstract_fa = {بار اثبات عناصر سه‌گانه تشکیل‌دهنده جرم اعم از عنصر قانونی، مادی و روانی به‌همراه فقدان موانع تحقق جرم با استناد به قاعدة «البینه علی المدعی» و با رعایت معیار مندرج در قانون، برعهده نهاد تعقیب است. این امر شامل اثبات رفتار مجرمانه اعم از فعل یا ترک فعل، انتساب عمل مجرمانه به مرتکب، سوءنیت عام و خاص و علم و عمد در جرایم عمدی و تقصیر جزایی در جرایم غیرعمدی می‌شود که اثبات عنصر مادی آن از طریق ارجاع امر به کارشناس نیز امکان‌پذیر است. هرچند در قوانین مجازات اسلامی و آیین دادرسی کیفری، به تبعیت قاضی از نظریه کارشناس اشاره نگردیده و تنها به‌عنوان یکی از امارات و قرائن علم‌آور برای قاضی شناخته شده است لکن رویکرد رویه قضایی دائر بر ارجاع امر به کارشناسان برای بررسی آثار و نتایج ناشی از جرم اعم از الکترونیکی و پزشکی از قبیل پیامک، اثر انگشت، منی، لکه خون، بزاق و ... و نیز بررسی اظهارات شهود، مطلعین، شاکی و متهم، نشانگر توجه دادگاه‌ها به ادله علمی جهت اثبات عنصر مادی جرم است.}, keywords_fa = {بار اثبات,جرم,عنصر مادی,کارشناس,رویه قضایی}, url = {https://www.ghazavat.org/article_223561.html}, eprint = {https://www.ghazavat.org/article_223561_9235adad09ee42eca47db7d69af5f4cb.pdf} }
