The trade law enacted in 1311 is the most important law in our legislative system that has defined the regulations dominating the commercial documents. This act that is the defected translation of French commercial law of 1807 does not cover the clear and comprehensive rules on commercial documents, for this reason, different viewpoints and interpretations have been presented regarding the commercial documents and different subjects related to these documents. These opinion contradictions caused the non presence of similar judicial attitude on the claims related to the commercial documents and contradictory rulings are given in this context. The present paper is of the intention that most important opinion contradictions should be expressed by stressing on the divergence of judicial ruling related to the commercial documents in which the contradictory judicial ruling has more prominence. In addition, the deficiencies of trade law should be pictured with a different justice that has been issued and enacted by non similar and contradictory judicial ruling regarding the similar and same subjects.    در کنار قانون صدور چک مصوّب 1355 با اصلاحات بعدی آن که تنها در مورد چک‌هایی اعمال می‌شود که محال‌ علیه آن بانک باشد، قانون تجارت مصوّب 1311 مهم‌ترین قانون در نظام قانون‌گذاری ماست که قواعد حاکم بر اسناد تجاری را بیان کرده است. این قانون که برگردان ناقصی از قانون تجارت 1807 فرانسه است مقرّرات صریح، روشن و جامعی در مورد اسناد تجاری در بر ندارد و به همین دلیل، نظرها و تفسیرهای متفاوتی در مورد اسناد تجاری و موضوعات مختلف مرتبط با این اسناد ارائه شده است. این اختلاف‌ نظرها، در عمل نیز موجب گردیده است که رویه‌ قضایی یکسانی در مورد دعاوی مرتبط با اسناد تجاری وجود نداشته باشد و آرای متناقضی در این زمینه صادر گردد. در مقاله‌ پیش رو با تأکید بر نشان دادن تشتّت آرای قضایی مرتبط با اسناد تجاری، تلاش گردیده است که مهم‌ترین اختلاف‌ نظر‌های مرتبط با اسناد تجاری که صدور آرای متناقض قضایی در مورد آنها برجستگی بیشتری دارد بیان گردد و نارسایی قانون تجارت با عدالت متفاوتی که از صدور آرای قضایی ناهمسان و متناقض در موضوعات مشابه و یکسان واقع گردیده است به تصویر کشیده شود. https://www.ghazavat.org/article_153505_bd9e2dc9337dd327b64f7ce65b9de5a8.pdf
