In such a way that it will not only result in the disciplinary violation of the judge, but it will also cause the decision to be invalid in some cases, and in higher authorities, it will cause the cancellation of the petition; Therefore, the realization of the right and the implementation of justice in the courts require that the platform and context be provided for the litigants so that the parties can easily present their claims and arguments. There are still legal loopholes regarding the investigation of such issues, even though they are major. For example, the situation when the order of the meeting is disturbed by one of the litigants and their lawyer is not clear. Therefore, this study is trying to analyze each of the examples that cause the necessity of order in the hearing.   اصل مسلم این است که در خصوص تشکیل جلسات دادرسی و اداره آن‌ها هرگاه موازین قانونی از قبیل احراز قانونی اطلاع و ابلاغ، عدم فوت و حجر طرفینی و تطبیق مفاد دادخواست با موازین قانونی صورت نپذیرد و بی‌جهت جلسه تشکیل شود، دارای ضمانت اجرا خواهد بود، به‌طوری‌که نه‌تنها تخلف انتظامی قاضی را در پی خواهد داشت، بلکه موجب خواهد شد رأی در بعضی موارد بی‌اعتبار باشد و در مراجع بالاتر موجبات فسخ دادنامه فراهم آید؛ بنابراین، احقاق حق و اجرای عدالت در محاکم مستلزم این است که بستر و زمینه برای اصحاب دعوی فراهم شود تا طرفین بتوانند به‌راحتی ادعاها و ادله و استدلال‌های خود را طرح نمایند. در خصوص بررسی هرچند عمده این‌گونه موضوعات همچنان خلأهای قانونی وجود دارد. به‌عنوان‌مثال وضعیت به هنگام اخلال در نظم جلسه از سوی یکی از اصحاب دعوی و وکیل آن‌ها مشخص نیست. لذا این مطالعه در تلاش است تا هر یک از مصادیقی که موجب ضرورت وجود نظم در جلسه دادرسی می‌گردد را تحلیل نمایید. https://www.ghazavat.org/article_712766_489457d9a89b1f8e578885c7874460eb.pdf
