Abstract

Restorative justice is one of the types of justice in the criminal law system, which instead of relying on punishment and strengthening its aspect, by combining some of the features of the criminal system of the descent and the criminal system of rehabilitation focuses on compensating for the losses suffered and the social fate- family and even all of society. Therefore, the main concern of this kind of justice is the compensation of the victim and the retribution of the offender to the community without the execution of the punishment or the minimum punishment. In this paper, we will examine the approaches and programs that are applicable to children and adolescents in the process of prosecution and preliminary investigations. Considering the specific psychological and physical conditions of this age group and their greater vulnerability, attention to restorative approaches is important to them. Finally, we will conclude that the lawmakers in the penal code of 1392 have considered restorative and semi-restorative approaches to children and adolescents, which are consistent with the principles of restorative justice.
