Abstract

One of the important issues is the investigation of the liability for the loss of car price, considering that this issue is not explicitly mentioned in the laws of Iran, insurance companies do not pay this type of damage.But with the review and concept of the existing laws, including (Civil Liability Law and Law on Compulsory Insurance of Damages Caused to Third Parties by Accidents Caused by Vehicles) and legal principles, insurance companies are obliged to pay all damages (up to the limit of financial obligations) from Among the damages are the drop in the price of the car, and also, on the other hand, a recent ruling from the fifth branch of the Supreme Court states that (the drop in the price of the vehicle caused by a traffic accident that is attributed to the culprit of the accident cannot be claimed from the insurance company if, in the insurance contract it has been specified) has been issued that this article tries to criticize and review the issued decision.
