Abstract
The absence of a comprehensive and clear definition by the legislator regarding offenses against chastity and illicit relationships has led to judicial divergence and multiple opinions in courts. Nowadays, in the realm of the judiciary, the focus is primarily on judges conducting investigations based on the application of Article 306 of the Criminal Procedure Code enacted in 2013. Due to the lack of a clear definition in this regard, cases of this nature are often not pursued, and the files are promptly referred to the court. The question that may arise here is: What is the task in the realm of the judiciary and in the context of preliminary investigations in dealing with such cases? Is the judges' generalized approach accurate as described above? Also, can changes in the concept and scope of the jurisdiction of the judiciary in crimes against chastity gradually influence the judicial and societal attitudes towards these crimes? In this regard, the concept of jurisdiction and its limits in the judicial procedures in Iran will be addressed as a major challenge, followed by an analysis of judicial decisions and trends in this area. This article emphasizes that a precise understanding of these issues provides a basis for improving justice in the light of legal and judicial principles, which can have a broader impact on the legal measures and policies of society. Changes in the concept and scope of the jurisdiction of the judiciary may also affect public opinion and judicial institutions, thereby influencing societal dynamics in the realm of chastity and the promotion of ethical principles. The research methodology is applied in terms of purpose, qualitative in terms of method, and data collection is based on library and internet resources.
