Analyzing Reliance on the Child’s Best Interests in Custody Disputes: A Comparative Study of Legislative and Judicial Approaches in the French and Iranian Legal Systems

Abstract
In recent decades, following conceptual developments in family law, the best interests of the child has emerged as a central standard in judicial custody practices, enabling the State to recognize children’s rights as those of autonomous rights-holders. The French Civil Code—an influential model for a number of legal systems, including Iran—explicitly requires that the child’s best interests be taken into account in all custody-related rules. In Iran, too, after accession to the Convention on the Rights of the Child, the Family Protection Act of 2013 (1391) expressly prioritized the child’s best interests in decisions of the Family Court. Nevertheless, the criteria for determining the child’s best interests have consistently faced challenges. Through a comparative analysis of custody-related legislation in Iran and France and a set of judicial decisions from the courts of both countries, this study examines how the legislative framework and judicial practice in these two legal systems invoke and operationalize the concept of the child’s best interests, and to what extent they rely upon it in adjudication. The analysis indicates that Iranian courts have tended to invoke the child’s best interests primarily where doing so allows them to move beyond statutory constraints tied to age and gender criteria governing maternal custody; otherwise, custody is often determined chiefly on the basis of the child’s age and the parent’s gender, with limited reliance on best-interests reasoning. By contrast, French courts have, from the outset, placed primary emphasis on securing the child’s rights through a more open-ended assessment of the child’s best interests. Reviewing the case law, the authors conclude that Iranian judges—under the influence of a “childhood doctrine” that accords greater weight to maternal rights—have not sufficiently utilized the legal capacity of the best-interests principle to prevail over other indicators, a shortcoming that has produced discernible adverse effects on the rights of children and, in some cases, mothers. Accordingly, the article proposes measures such as encouraging judges to assess best interests in all cases in light of international indicators, and reconsidering the manner in which the prerogatives of the legal guardian (wali-ye qahri) are exercised so as to better protect children’s rights.
