Dismissals and administrative installations are intra-organizational decisions with a specific legal effect and are distinguished from administrative actions due to having these legal effects. In some legal systems, internal actions of the administration or actions that do not have legal effect are not subject to judicial supervision. In Iran, the administrative and employment organization of the country is a government organization that is responsible for the duties of the president in the administrative and employment field, and its head is the vice president. The important activity of this organization is to compile civil service management laws, prepare bills for large government organizations, and draft policies and general regulations of the administrative system. Currently, the official in question is a PhD student in human resources management and an associate professor of Imam Sadiq University (AS), which is considered to be a non-governmental organization and symbol in the Ministry of Science based on the law and the list of non-governmental institutions, including non-profit universities. The administrative and employment organization faced the reaction of the government, which the spokesperson of the government, while criticizing the decree, emphasized that the law and legal procedure allowed the use of the capacity of professors and faculty members of independent and non-governmental universities in executive positions, and the procedure of various executive bodies And it has been judicial. The present study seeks to examine the reason, why and how of administrative appointments according to the laws and regulations and the judicial procedure of the competent courts through a descriptive-analytical study.
