This paper explores the intersection of literature and law. Through a focused analysis of select works by Franz Kafka—specifically The Trial (and the embedded parable "Before the Law") and The Judgment—the author examines key issues within these texts by employing a problem-oriented approach and considering interpretative methodologies grounded in literary logic and issue analysis. The paper raises several pertinent questions: Did Kafka, in these narratives, engage with the ethics of criminal justice and its potential violations? If so, what specific instances of ethical breaches did he highlight, and what preventive solutions did he propose? The findings suggest that Kafka indeed underscored the necessity of ethical adherence within criminal justice. He appears to have been critical of instances where ethical breaches occurred, potentially implicating lawmakers, judges, lawyers, and police officers. Through his unique literary style and understanding of legal concepts, Kafka conveys implicit preventative measures by evoking these ideas in the reader's imagination. His abstract portrayals invite readers to draw parallels between the fictional events and real-world practices, thereby fostering a critical view of various legal and ethical issues, such as the criminal justice system, the role of its actors, and the processes of legislation and adjudication.
