Abstract
Article 4 of the Civil Registration Law sets forth the rule that, in disputes concerning civil registry documents, jurisdiction lies with the court of the plaintiff’s domicile. The Note to that Article, as an exception to the rule stated in the main text, provides for two exceptional situations: (1) where the document was issued in Iran and the plaintiff resides abroad; and (2) where the plaintiff resides abroad and the document was also issued abroad. Article 25 of the Code of Civil Procedure, in an incomplete formulation, reproduces the wording of the Note to Article 4 of the Civil Registration Law while omitting the rule contained in the main text of that Article. This legislative arrangement has given rise to ambiguity and competing interpretations. The present study shows that, in enacting Article 25 of the Code of Civil Procedure, the legislature merely intended to consolidate the rules relating to jurisdiction, rather than to negate the rule set out in the main text of Article 4 of the Civil Registration Law. Nevertheless, in transferring the content of Article 4 of the Civil Registration Law into Article 25 of the Code of Civil Procedure, the legislature acted imprecisely.
