منظور از حقوق بشر چیست؟ دﯾﺪﮔﺎه‌های چهار مکتب فکری درباره ﺣﻘﻮق ﺑﺸﺮ

چکیده

بررسی نوشته‌های آکادمیک نشان می‌دهد که ما درک یکسانی از حقوق بشر نداریم. لذا این نوشتار درک مکاتب فکری مختلف را در این زمینه ارائه می‌دهد. بر این اساس، اندیشمندان مکتب طبیعت‌گرا حقوق بشر را به‌عنوان امری معین، مطلق، فطری و طبیعی تلقی می‌کنند. ازطرفی متفکران مکتب توافقی، به توافق در مورد حقوق بشر اعتقاد دارند و موجودیت حقوق بشر را در توافق اجتماعی حول محور آن تصور می‌کنند. محققان مکتب اعتراضی نیز معتقد به مبارزه برای حقوق بشر هستند و در نهایت در مکتب گفتمان، مردم در مورد حقوق بشر گفت‌وگو می‌کنند. موضع هر یک از این چهار مکتب فکری در زمینه بنیادهای حقوق بشر، جهان‌شمول بودن آن، درک حقوق بشر و قوانین مربوط به آن و همچنین اعتقاد یا عدم اعتقاد این مکاتب به این مواضع مورد بررسی قرار گرفته است. متون آکادمیک حاکی از آن است که چگونه این چهار مکتب فکری، با ارائه نمونه‌هایی از علم فلسفه، علوم سیاسی، قانون و انسان‌شناسی، از دانش‌ها و رشته‌های آکادمیک فراتر می‌روند.
