توقیف کشتی حامل محمولۀ نفت ایران (گِریس ۱) به واسطۀ ورود به مرزهای اتحادیه اروپا

چکیده
در 14 تیر ماه 1398 (4 ژوئیه 2019)، نیروی دریایی بریتانیا کشتی «گِریس 1» را که حامل 2.1 میلیون بشکه نفت ایران بود، با این ادعا که به‌ واسطۀ ورود به دریای سرزمینی جبل‌الطارق، وارد مرزهای اتحادیۀ اروپا شده و با انتقال نفت به سوریه، دستورالعمل تحریمی اتحادیۀ اروپا را نقض کرده است، توقیف می‌کند. تنگۀ جبل‌الطارق شش مایل دریای سرزمینی دارد که نسبت به سه مایل آن، ادعای دریای سرزمینی جبل‌الطارق مطرح است. همچنین، با توجه به شرایط این منطقه، حق عبور ترانزیت در آن برقرار است. علی‌رغم ادعای بریتانیا در خصوص مکان توقیف کشتی، بعید به نظر می‌رسد که با اینکه کشتی «گِریس ۱» می‌توانست از منطقه‌ای به‌جز دریای سرزمینی ادعایی جبل‌الطارق عبور کند، ترجیح دهد تا ـ با وجود جوّ منفی موجود در جامعۀ بین‌المللی علیه ایران ـ از دریای سرزمینی ادعایی جبل‌الطارق عبور کند. بنابراین بریتانیا با توقیف کشتی «گِریس ۱» در خارج از مرزهای اتحادیۀ اروپا که قطعاً دستورالعمل‌های آن قابلیت اجرا ندارند، یک عمل متخلفانۀ بین‌المللی انجام داده است که موجبات مسئولیت بین‌المللی این دولت را فراهم می‌آورد.
