ابهامزدایی، ایضاح و تکریم ویژگیها و فضیلتهای قضات شایسته سبب میشود قضاتی که فاقد این فضیلتها هستند نیز در یک فرایند مداوم یادگیری و تقلید، شایستگیهای خود را افزایش دهند و نهایتاً این فرایند به بهبود و ارتقاء جایگاه دستگاه قضا در افکار عامه جامعه منتج شود. مقاله پیش رو در راستای دستیابی به هدف مزبور، با رویکردی تاریخی-مقایسهای به بررسی فضیلتهای قضایی در ادوار تاریخی، فرهنگهای حقوقی متفاوت و نظریات مطرح در علم حقوق میپردازد و به صورت اجمالی به نقش قضات در اروپا و بازتعریف آن تحت تأثیر پدیدههای نوظهوری چون بینالمللی شدن قوانین و اهمیت یافتن منشور حقوق بشر اشاره میکند. افزون بر آن، پژوهش حاضر با انجام نظرسنجی از قضات شاغل، قضات کارآموز و دانشآموختگان حقوق متقاضی شرکت در آزمون قضاوت، فضیلتها و مهارتهای قضات شایسته را شناسایی کرده و در کانون توجه قرار میدهد و در این راستا، این استدلال را مطرح میکند که قضات شایسته تجسمبخش ارزشهای والایی چون استقلال و بیطرفی، قابلاعتماد بودن و اخلاقمداری خواهند بود.
